DISPUTE SETTLEMENT PROCEDURE  

In regard to disputes relating to the provision of legal services, BBH Immobilien GmbH & Co. KG (“the company”) is prepared to participate in an alternative dispute settlement procedure pursuant to the Act on Alternative Dispute Resolution in Consumer Matters (Gesetz über die alternative Streitbeilegung in Verbrauchersachen – VSBG).

According to this Act, consumers within the meaning of section 13 German Civil Code (Bürgerliches Gesetzbuch – BGB) (“consumers”) may – for the purpose of conducting a conciliation procedure – call on the consumer conciliation body (Verbraucherschlichtungsstelle) within the meaning of the Act on Alternative Dispute Resolution in Consumer Matters if they have previously made a complaint to the company. If no more than two months have passed since the claim under dispute was first notified to the company and if the company has during that time neither accepted nor rejected the claim under dispute, the company may request for the conciliation procedure to be suspended for the remainder of the two months. Filing the complaint with the consumer conciliation body suspends the statutory limitation period pursuant to section 204 subsection 1 no. 4 BGB. This does not affect the right of the parties involved to pursue the matter before the courts or to apply for a different procedure.

For online business transactions: Consumers may use the online dispute resolution (ODR) platform of the European Union to obtain free advice in regard to filing a consumer complaint relating to an online contract for the purchase of goods or services and to receive information on the procedures of the consumer conciliation bodies of the European Union.
